Unrivalled expertise acting for pharmacists in relation to disciplinary proceedings, inquests and regulatory crime

- Legal 500 (2014)

Kevin is instructed in healthcare disciplinary and regulatory work, with particular expertise in pharmacy cases. He also undertakes general criminal work and has experience in fraud, with a specialist knowledge of pharmacy fraud. Whilst generally acting on behalf of the defence, he has been instructed in fraud prosecutions as detailed below. Kevin has acted both as junior and leading junior.

Kevin is recommended as a leading junior for Professional Discipline and Regulatory Law in Legal 500 2012 and Chambers and Partners 2012.

Healthcare/Regulatory

Kevin is regularly instructed, by a number of solicitors nationwide, to represent pharmacists facing proceedings before the Disciplinary Committee of the Royal Pharmaceutical Society, (previously the "Statutory Committee") and has appeared in the Administrative Court on Appeal. He was instructed as a junior counsel in the RPSGB Inquiry into the pharmacist who supplied diamorphine to Dr. Shipman.

He is familiar with the spectrum of issues which frequently arise before the Disciplinary Committee, including allegations of dishonesty, repeat prescription fraud, small pack fraud, dispensing errors, inappropriate conduct and offences pursuant to the Medicines Act 1968. For those pharmacists who face criminal and subsequent disciplinary action, continuity of counsel is available throughout. He has advised in relation to appeals by CHRE (Council for Healthcare Regulatory Excellence) and in respect of the regulation of pharmaceutical services within hospitals.

Kevin is also instructed to act on behalf of Primary Care Trusts before the Family Health Service Appeals Authority in relation to appeals arising out of the removal of general practitioners and pharmacists from the performers and pharmaceutical services lists.

Kevin has acted on behalf of pharmacists, pharmaceutical employees and general practitioners at Inquests.
