Mark Wyeth QC Secures Acquittal in a 'highly unusual' HIV transmission case

Mark Wyeth QC leading Robert Ellison of 5 Kings Bench Walk (a recognised specialist in HIV transmission cases) on the 20th of February 2013 before Southwark Crown Court secured the acquittal of a 38-year-old man accused of transmitting the HIV virus to another male.

The learned trial Judge upheld Mark’s legal submission that the conflicting medical experts' opinions rendered the case unsafe to be left to the jury. The submission came at the end of a six day trial in which two eminent Professors disagreed regarding the conclusions to be drawn from phylogenetic analysis of the respective parties’ blood samples.

The case is believed to be the first to consider this highly specialised area of medical science and analysis.
