Client acquitted of Death by Dangerous Driving and causing serious injury by dangerous driving in “Spotify killer” case

Client, represented by Miles Bennett acquitted after week long re-trial. The Crown’ allegation supported by the Defendant’s own passenger was that at the time of the fatal collision, with the defendant’s van on the wrong side of the road, he had been holding his mobile phone and selecting music from his Spotify account. Miles was instructed by Neena and Rekha Sharma from Keogh’s Solicitors. The Defendant, who had pleaded guilty to causing death by careless driving at an earlier hearing, denied that he had been holding his phone or selecting music at the time. His case was that he carelessly looked out of his van window which he was winding down at the time and hadn’t realized that he had crossed into the wrong carriageway. The original trial had been halted because of serious prosecution non-disclosure in relation to enquiries with Spotify that had been inconclusive. The Defendant is awaiting sentence.
